    Title: 人性尊嚴的移植與混生—台灣憲政秩序的價值格局

    Abstract: 人性尊嚴，經由大法官引介、確認，不僅成為臺灣自由民主憲政秩序的核心價值，更擁有基本權利性格，不容國家權力，以任何理由、任何方式，加以侵害。原本是〈世界人權宣言〉揭示的尊嚴法理、德國基本法明定人的尊嚴，經由司法院大法官權威憲法解釋的引介，已移植深耕於臺灣憲法秩序。憲法修正條文原有的人格尊嚴，遭逢人性尊嚴移入，歷經思想論辯的反覆咀嚼、消化，最後混生（hybrid）成為具有臺灣風格的階層化尊嚴論述。在大法官憲法解釋文本，無論出現的是人性尊嚴、人格尊嚴，或是個人主體性、人格自由發展，這些關鍵用語，最終都指向以自由理念為論述基底的人的形象。在人性尊嚴的移植與混生歷程裡，我們不僅見證自由民主憲政秩序的誕生，也看到臺灣憲政秩序以自由理念為核心內涵所確立而成的價值格局。
