    Abstract: 在確立身分犯正犯性認定的前提問題後，本研究計畫欲緊接著進一步處理身分犯的另一項重要議題，亦即「共犯與身分」的難題。本研究計畫預計將研究重點集中在以下幾個重要的問題：第一、有關我國刑法第三十一條第一項和第二項規定，其間內在處罰根據的衝突問題；第二、則將焦點關注於這兩項規定的具體適用關係；第三、思考這兩項規定的減刑方案可能衍生的不公平待遇問題；第四、嘗試處理最複雜的難題，究竟犯罪構成要件中哪些要素才是屬於我國刑法第三十一條的身分或其他特定關係，有刑法第三十一條的適用？這涉及將各別身分犯構成要件的不法結構和法益保護進行徹底的分析。 After the issue of the guilt of the special crime is solved, this research project attempts to address another important problem: parties and special personal characteristics. This project will focus on the following questions. Firstly, is there an inside conflict between Article 31 section 1 and section 2 of the Penal Code? Secondly, how can we concretely apply Article 31 section 1 and 2? Thirdly, how can we prevent the unfair leniency each according to Article 31 section 1 and section 2 of the Penal Code? Fourthly, this project attempts to research, which features on the criminal facts belong to the special personal characteristics according to Article 31 of the Penal Code? It requires a detailed analysis of the structure of injustice and the protection of legal rights of the individual offenses.
