    Abstract: 準強盜罪保護財產法益，應以財產法益為中心進行解釋。其客觀要件必須先構成竊盜或搶奪既遂，或至少已經達到物理控制動產的未遂罪，如果行為人的前行為僅達物色竊取財物，雖然也構成竊盜未遂罪，但因尚未物理上控制動產，仍不成立本罪。基此，準強盜罪的既遂時點，指的是行為人透過強暴、脅迫行為而穩固了前行為所侵奪同一動產的持有。至於主觀要件，行為人實施後行為時，必須延續原竊盜或搶奪行為的主觀不法意圖，此即防護贓物意圖，欠缺此項意圖即不成立準強盜罪。脫免逮捕或湮滅罪證意圖僅是從屬性質的量刑例示規定，不能構成準強盜罪。
