Title:	不能安全駕駛罪與過失實害犯的罪責及競合難題--兼評最高法院100年度台非字第373號刑事判決

Abstract:	導讀 1.酒後開車而過失肇事的行為人，可能欠缺責任能力及過失罪責（遵守注意義務的個人能力），但此屬行為人自行招致的能力欠缺，行為人不得主張因系爭能力欠缺而排除罪責，仍應認為具有完整的罪責。 2.酒後開車而過失致人於輕傷，同時構成不能安全駕駛罪及過失致傷罪，在第185條之3第2項訂定結果加重犯之前，考量兩罪的實行行為並未真正同一，應認為是兩行為而併罰，但增訂結果加重犯之後，立法者宣示整體損害流程（抽象危險的駕車以及嗣後發生具體危險的過失肇事行為）均為行為單數的範圍，屬於構成要件行為單數，兩罪具有想像競合關係從一重處斷。
