Title:	國際氣候變遷法制2.0：巴黎協議評析

Abstract:	本研究集中在對於2015年底甫通過，2016十月生效之巴黎協議，就相關主要內容與後續談判進展進行介紹與相關評估。基本上，本研究認定巴黎協議本身為一份具有法律拘束力之文件，但相關具體拘束內容，仍須就個別之條文逐一觀察。整體上，本文認為巴黎協議之生效，對於全球氣候變遷之治理，至少解決了後京都時期之規範基礎。但其後續具體工作項目與成效，仍有待後續持續追蹤與觀察。 This study focuses on the introduction of the provisions of the Paris agreement, which was passed at the end of 2015 and entered into force in October 2016, and the progress of the follow-up negotiations and related evaluations for it. Basically, this study finds that the Paris Agreement itself is a legally binding document, but the relevant binding content is still subject to individual articles. On the whole, this paper argues that the entry into force of the Paris agreement, for the governance of global climate change, at least settled the basic norms for the post-Kyoto climate regime. But its follow-up specific work projects and its effectiveness, remains to be followed by continuous observation.
