    Title: 持有獵槍、獵捕保育類野生動物與原住民慣習間的衝突及解套： 評宜蘭地方法院104年度原訴字第1號刑事判決

    Abstract: 本文以一則判決為例，討論原住民因實踐其文化行動而觸犯刑法時，能否除罪的問題，筆者個人見解認為：（1）槍砲彈藥刀械管制條例第20條第1項「供作生活工具之用」的解釋上，「生活」應該同時包括經濟、祭典與原住民文化生活，此外，亦不應過度局限於「傳統慣習」的時間性，否則法律除罪規定反而會阻礙原住民文化的發展與適應效能。（2）野生動物保育保法第21條之1第1項，應適用至獵捕、宰殺「保育類野生動物」的除罪化，即使原住民未依同條第2項事前取得主管機關核准，但只要符合第1 項所稱的「基於傳統文化、祭儀」，就可以排除刑責。至於傳統文化的解釋，不應過度局限於管理辦法所稱的祭典或禮俗，毋寧應擴大解釋至所有與原住民有關的文化生活方式。
