    Abstract: 在現代化社會快速變遷中，許多新型契約應運而生，養護（長期照護）契約涉及人口高齡化、社會結構及人倫秩序的新挑戰，相關問題所涉法律層面的思考，具有頗為不同的特性及因應方式。臺灣社會所使用養護（長期照護）定型化契約，涉及養護機構與受照顧者間的特殊關係，係以中央主管機關所公告應記載及不得記載事項的法律架構為基礎，對於契約主體的主、從給付義務及附隨義務，及雙方權利義務關係的平衡，多所斟酌。尤其對於終止契約相關事由及條件，頗多著墨，控管密度頗高，堪稱有效保護消費者權益的適例，同時展現以公法手段調控私法的特性，與非訟程序類似，同屬為私法秩序效勞的國家行政活動。這種為實現維護人性尊嚴的基本價值，而逐漸產生兩大領域融合、互補的傾向，將是私法學者未來所應共同面對的課題。
