Abstract:	有鑑於鎘污染土地、海砂屋、幅射屋事件,臺灣於一九九三年制定消費者保護法時,特別將不動產列入商品責任規範範圍。一九九九年九二一大地震來襲,這場百年來最大規模的地震,雖造成巨大損害,似也成為檢驗相關責任規範的難得機會。一系列以房屋安全為核心問題之消費訴訟,帶來不少棘手課題。最高法院九十八年度台上字第一七二九號判決具體呈現了多年來反覆困擾實務的爭議,映照出商品責任當前面臨之挑戰。本文將先介紹該判決之事實與法院見解(貳),繼而以該案爭點為綱,說明臺灣實務與學說如何回應商品責任之挑戰(參),最後提出結論(肆)。
