Abstract:	依本件台灣台北地方法院合議庭之見解,本件信用卡正卡持有人與附卡持有人對於正附卡持有人就正、附卡使用所生之一切帳款,應否互負連帶清償責任,應視系爭信用卡約定條款中是否已明文約定;其次,附卡持有人之年紀,教育程度是否足以理解認知此等文字。另外,上開條款約定內容是否有違反法律規定而應屬無效等均為本判決之事實上及法律上之爭點
