    Abstract: 南中國海海權爭議已從單純國際法理爭議,轉變至複雜之國際關係衝突。本文嘗試援引「國際習慣法」與「中華世界秩序原理」,以交互檢視近代中國政府在繼受中華古帝國之南海歷史性海權遺產之際,如何相應並落實當代國際海洋法制度,進行對南中國海之法政建制。文中並同步引介現今環南海諸國所生之國際衝突關係及歷程,作為徵驗環繞中國之週邊國家,其嘗試藉由西傳之當代國際法挑戰業已長久存在於東亞之「中華帝國與中華世界秩序」之實例。於今日國際海洋法尚未對歷史性水域制度實證性明文確認前,本文將藉由上溯兩項概念內涵之闡明,檢視今日環南海諸國除爭相競奪此處海權、資源外,尚且存在著對「古中華帝國與中華世界秩序」之隱性反動抗辯。
