Title:	WTO View of the Netherlands` Trade and Industry 荷蘭貿易商與產業界對WTO的看法

Abstract:	在坎昆會議之前，我幾乎認為會議結果將是不證自明的。我們已有以杜哈宣言為基礎的杜哈發展議程、主要WTO會員國的協商立場與協商的時間表三項足以制訂許多決策的要素。雖然仍須費些時間作調整與澄清、再次肯定政治承諾，但是終將會有實質決議。我僅需就荷蘭商界的觀點對這些決議發表評論。孰料現在我必須就WTO的一些非常根本的問題加以解釋。例如坎昆會議失敗的真正原因？會造成哪些後果？此次會議協商破裂會對WTO造成哪些衝擊？如果我們要會議再開，如何才能使各國重回談判桌？這是本文所要探究的四個問題。坎昆會議的癥結所在：第一，在許多問題的本質上，各國有不同的看法，最主要的爭議是在投資、農業、棉花提案以及對發展中國家特惠待遇等。其二是有政治考量。發展中國家，尤其是G21裡的印度、巴西、中國與南非等國以及非洲國家的一些團體扮演著特別凸顯的角色。由於這些國家長期以來對國際事務影響有限且在WTO又遭受不平待遇感到相當挫折，所以有意顯現他們在WTO的重要性以及增加談判籌碼。其三是與戰術遊戲和錯誤估算有關。其四是毫無疑問不少的WTO會員國對新自由化的努力有不同的看法。坎昆會議失敗的後果：杜哈回合如期結束的可能性微乎其微；坎昆會議的結果嚴重影響杜哈議程；歐洲聯盟的談判戰略出現瓶頸，對EU商界言是項挑戰；對美國的一些人言，此次會議失敗再度證明多邊機制不管用；WTO部長會議決策制訂程序將遭受嚴重抨擊：發展中國家已實質增強他們在WTO的政治影響力；發展中國家雖然在政治上獲勝，但是最貧窮國家將為此付出經濟代價；非政府組織(NGO)可能因此失去更正式參與WTO過程與爭端解決機制過程的支持：和平條款(peace clause)將無法再延期。
