Abstract:	國際貿易法源于中世紀的商人習慣法，形成於第二次世界大戰結束前夕。半個多世紀以來，無論是國際貿易法的調整物件，還是它的調整手段，都已經發生了深刻的變化。國際貿易法與民商法原有的那種淵源關係已經變得越來越模糊，法律的自治性正逐漸被政府管理的強制性所取代。近年來，規範政府管理國際貿易的條約大量出現，世貿組織框架內的多邊貿易體制基本形成，從而使現代國際貿易法的統一由私法領域轉向公法領域。這些變化迫使我們去思考如何在中國重新構建一個科學的國際貿易法學體系。將世界貿易法從目前的國際貿易法學科中分離出來，正是基於上述思考提出的一種設想。區分國際貿易法與世界貿易法的意義在於明確這兩者的法律淵源不同，適用的法律原則以及調整物件和調整手段也有很大的差別。這種區分既有利於人們正確了解世界貿易法這一新的法律領域，也有利於恢復國際貿易法這一學科的本來面目。
