| Abstract: | 當代社會面臨嚴重的民主衰退與分歧對立，致使政府功能與其他社會機制難以運作，顯著者如比利時在2010年大選後歷經八個月多沒有中央政府的僵局、2013年美國兩黨鬥爭下的預算案擱置使中央政府大部分單位停擺了將近三週。臺灣社會同樣面臨相似困境，國族意識形態差異、法律繼受背景、現代治理困境與全球化帶來的價值衝突，導致政治極化，並在網路平台的言論環境中進一步加劇社會分化與社群衝突。本文循 Cass Sunstein 的理論框架，從憲政領域的公民共和主義出發，整合植基於認知與行為科學的管制理論，並考察與分析網路平台如何形塑言論、社群文化與民主社會，最終總結此理論進路的侷限與其他發展可能性。 |
