    Abstract: 刑法學理和實務上普遍承認的間接正犯（mittelbare Täterschaft），一般認為，是一為了彌補法律可罰性漏洞所創設出的法樣式，使幕後利用人也擔負起正犯的責任。然而，關於間接正犯的法理依據，始終眾說紛紜，故本文希望藉由此一議題，能夠提供一條迥異於傳統的思考途徑。本文主要可以分為二大部分，其一，本文將回溯探討正犯概念的理論爭議，尤其於我國實務採取限制正犯概念和形式客觀理論下，間接正犯有無成立的空間，恐怕值得商榷，故本文提出以實質構成要件觀點檢驗正共犯區分之構想 ; 其二，本文將探討間接正犯的法理根據，並於文末指出，間接正犯其實並不是我國實證法上的例外類型，而是一種典型。
