摘要:	本研究焦點為以宜蘭礁溪溫泉旅館業者為研究對象，檢視其執行營業衛生管理自治條例的個案研究，並藉由「衛生自主管理」、「強化自主採水送驗」核心概念，檢視與發掘業者在配合自主管理之阻礙與困難。透過研究發現，在營業衛生管理自治條例的管制法令介入後，業者抱持自主管理的態度，並於遵從法令的規範下，在對內規範員工與對外滿足顧客的需求，皆有所依循。稽查人員必須依法執行並輔導業者。然而，目的機關強化稽查員人員對法令的熟悉與建立工作標準作業程序，並提供完善的檢核機制，能降低管制失靈的狀況。簡化溫泉旅館業者申請溫泉標章作業程序，因受限法令與主管機關差異，仍有待協調與突破。建議未來透過跨部門的合作修改法令，提升機關執行管制成效。 This research, a case study of the hot spring hotels in Jiaoxi Township of Yilan County, focuses on evaluating how effectively the hotels have implemented the Self-governing Regulations for the Business Health Management. Moreover, based on the core concept of “Self-management of Personal Hygiene” and “Enhancing the Autonomous Submission of Water Sample for Inspection”, this research also tries to inspect whatever obstacles or difficulties the hotels have encountered. This research shows that, after the enforcement of the regulation, the hotels have autonomously abided by the regulation on both the employee management and the customer services. Furthermore, inspectors must assist the hoteliers with the practice of related regulations as well. On the other hand, it is also important for the Health Authority to strengthen inspectors’ knowledge of regulations, establish SOP (standard operation procedures), provide a complete inspection mechanism, and reduce regulatory failures. However, the SOP for hoteliers to apply for the Hot Spring Certificate still varies owing to not only the regulation itself but also the differences among authorities. It is suggested that each relevant department, such as public health, tourism department, among others, should collaborate on amending regulations to legislate unified regulations for both authorities and inspectors to abide by.
