Title:	直接民主在德國－一個初步觀察

Abstract:	在二戰後的制憲會議上，後來的第一任聯邦德國總統Theodor Heuss曾有句名言：「直接民主是對於所有煽動者的犒賞（Prämie für jeden Demagogen）」。他至少明白地指出：公民投票可能會造成爾後民主的負擔，讓立法機關必須時時維護的名聲毀於一旦。當然，晚近的研究已經難以印證這樣的負面評價，直接民主，至少就實證經驗上來說，未必只是宣傳煽動盲從者的工具，也不必然造成政治上的不穩定，雖然說，納粹與義大利法西斯的歷史教訓雖然與直接民主脫不了關係。沒有錯，正是戰前的十多年的威瑪經驗（1919-1933），乃至於法西斯毫不猶豫的宣傳與濫用包括直接民主在內的民主機制，讓重建自由民主憲政秩序的德國人，陷入了猶豫，也造就世人揮之不去的印象：直接民主在德國，可能貧乏而片斷。這篇短文之目的，從制度上，乃至於從學界對於是否應該更多的開放直接民主形式，直接民主的優缺點究竟為何，提供一些對於德國的初步觀察。
