    Abstract: 我國民法承認遺囑制度,不外乎在尊重遺囑人之遺志,而所謂遺志,應以遺囑人最後之意思表示為準,因此民法規定遺囑人有撤回遺囑之自由。詳言之,遺囑作成之時與遺囑發生效力之時可能中間相距甚久,在此長遠之時期內,各種情事之變更有時在所難免,如使遺囑人受最初所為意思表示之拘束,未免過於苛酷,此將使人心存戒心,不敢利用遺囑制度。且因遺囑而受利益之人,於遺囑生效前現實上尚未取得任何之權利,縱令遺囑人隨時撤回其遺囑,亦不發生侵害受益人既得權利之問題。要之,遺囑之可撤回性或可變動性,乃是其本質上所不可或缺之要素。
