Title:	知識經濟時代商標法:第一講新興商標類型的規範與發展

Abstract:	每個成功企業後面,都有一個為消費者所熟悉的商標,而商標也是決定消費者購買行為的主要原因之一。在商品與服務快速推陳出新,市場充斥各式商品與服務的今日,企業最核心的資產之一,就是用來表彰與識別其商品與服務的商標,而一個全世界知名的商標更是企業成功與國際化的保證。就商標的功能而言,其不但具有表彰商品或服務來源的功能,也具有保證品質的作用,例如有名的產品,不論是在世界的哪一個角落購買,消費者都可以確定會有一定的品質。此外商標更具有避免混淆誤認的功能,因此商標一旦獲准註冊,就可以發揮維護商標權人權利及消費者利益的功能,防止不公平競爭行為,促進工商企業正常發展。
