    Title: 民法繼承編：第十二講 遺囑之執行

    Abstract: 遺囑之內容有不須執行即可實現者,例如應繼分之指定(民法一一八七)、遺產分割方法之指定或指定之委託(民法一一六五Ⅰ)、遺產分割之禁止(民法一一六五Ⅱ)、遺囑執行人之指定或其指定之委託(民法一二九)、遺囑之撤回(民法一二一九)、監護人之指定(民法一九三),以上遺囑均不須執行,惟若以遺囑為捐助行為(民法六十、六二)、遺贈行為(民法一二至一二八)或為信託行為(信託法二)。此等遺囑非予以執行無法達到目的,至於以遺囑為認領時,有認為,該遺囑不必執行;對之,有認為非婚生子女之認領因遺囑本身而生效力,並非以遺囑之戶籍登記而生效力,故其婚生子女身分之取得,不以執行為必要,然子女以為遺囑人之子女公示於戶籍簿為其利益,與子女利益相反之繼承人如委以此項聲請,甚為危險,故戶籍法明定依遺囑為認領者,以遺囑執行人為聲請義務人。
