    Title: 危險的親密關係-不法意識的可分性

    Abstract: 在罪責要件的檢驗中,首先要思考的是行為人是否具備有辨識不法規範的能力,一般而言,只要是行為人在行為時具備有不法意識,應該可以被解釋為有罪責。所謂不法意識的內涵存在,並不以行為人完全理解或者知悉其行為具有可刑罰性為必要,只要行為人認識其行為為法規範所不容許,就可以解釋為具有不法意識,至於欠缺不法意識不會影響故意的成立,只會影響罪責。有問題的是,如果行為人的特定行為具備有數個構成要件的該當,但卻不存在有所有構成要件行為的不法意識時,是否應該將不法意識的存在按照個別部分作分離的判斷。換句話說,當行為人只對其某一行為具備有違法性的認識時,是不是也因此就解釋為其具有其他犯罪的不法意識。
