    Title: 親權法之現狀與課題

    Abstract: 親權法之發展,歷經制訂前多個草案版本及七十四年和八十五年兩次修正,我國親權法逐漸由家本位轉為父母本位再進而至子女本位。所謂親權,其本質在對外關係上,父母基於親權可排除他人干涉,具權利性;在對內關係上,則屬父母對子女保護教養義務。親權內容包括身上照護與財產照護,身上照護有關居所指定權、子女交還請求權、懲戒權、身分行為代理同意權等皆展現父母保護教養義務;而財產照護,有關子女特有財產之管理權為父母親之義務,關於特有財產之使用收益權(第一八八條第二項)由草案與歷次修法可知該規定是開時代之倒車,財產處分權則因第一八八條第二項但書不明確,故建議將之刪除。而第一八九條應修正為請求法院酌定由父母一方行使,而非讓法院取代父母之意思較妥。另外,離婚後協議共同監護對子女並無不利,第一五五條第一項修正值得肯定,但第二項與第四項則欠妥當。顯示我國親權法有重新檢討之必要。
