Title:	有責配偶之離婚請求—兼評最高法院九十三年台上字第九八七號判決

Abstract:	我國民法規定有責配偶不得請求離婚,與外國法規相較,顯得落伍。立法既有不當,則於適用上應限縮適用,但最高法院之判決卻曲解條文文義而擴大適用該但書規定,亦即,條文明確規定配偶為唯一有責者,不得請求離婚,但我國實務見解卻將之擴大為不僅唯一有責者,不得請求離婚,尚擴及於負主要責任之有責配偶,亦不得請求離婚,此種解釋已逾越文義解釋之範圍。再就比較法之觀點觀之,我國實務見解係參考一百年前瑞士民法或參考五十年前日本最高法院判決之見解而來,則於瑞士民法已刪除該條規定或日本最高法院判決已變更以往見解之今日,我國實務見解似有變更之必要。
