    Abstract: "作者在一九九五年八月從德國進修回國後,過去七年中嘗試在政治大學法律學系開設「德國法制史」課程,在授課中發現,一般學生對於德國法制史課程的好奇與興趣甚至是高於對於中國法制史的,然而在教授此一課程的過程中,作者往往面臨中文文獻資料不足,自行要寫上課講義的困境。而學生在上課時,因為中文文獻的不足加上作者個人在閱讀相關德國法制史的文獻時,往往因為自身對於德國文化,歷史了解的限制,而無法體會或掌握德文文獻中有關德國法制發展的敘述與說明,因此在教學中常面臨無法持續引起學生興趣的困境。作者向來認為要讓台灣的法學有所發展,如何將繼受外國法的經驗與本土傳統、現代的法制發展經驗融合是當務之急。因此希望利用今年休假期間,將這些年來,因為開設德國法制史課程所累積的相關講義有一百多頁,改寫為一本,⋘德國法制史概論⋙的書籍。希望除了可以給國內有興趣於德國法制史的人有一個參考的資料外,更希望這本書的出版可以吸引更多法律系的學生對於德國法制史的研究產生興趣,並在這個基礎上繼續努力。"
