    Title: 發展知識服務產業的法律問題與政策考量

    Abstract: 發展知識服務產業不受到時間空間的限制,亦可創造大量的工作機會並帶動知識的創新。我國在發展知識服務產業上,面對了幾個挑戰:一、在WTO架構下,服務貿易受到GATS的規範,其中的MFN(最惠國待遇)原則,要求各國開放服務貿易市場,我國必會面臨國際上之競爭。二、對於智慧財產的保護,WTO以TRIPs作為各國保護的最低標準,就我國而言,相關法規相當完備,但某些法規卻採取刑罰方式,或給予外國人較優惠的保護,對國內業者不利。三、國外業者常透過智慧財產權的保護,授權(licensing)給國內業者某些權利,由於這些權利為法律所賦予,形成壟斷,國內法並無完善規定,來規範授權行為。四、電子商務與網路交易平台,相關之商業交易方法或是網路軟體,是否應給予專利權保護,以及租稅問題。五、資料庫是否應該受著作權之保護,以及涉及公平法的法律問題。本文就此各面向加以討論。
