Title:	全民健康保險法制中裁罰性不利處分性質之探究：以現行行政法院判決為中心

Abstract:	行政契約的履約過程中，若為契約一方當事人之人民，未能遵守以契約確認之法定義務，其與締約行政機關間之後續法律關係處理，應優先依據行政契約為之，或是以其為法令義務由行政機關單方對締約人民作成行政處分或行政罰，一直是行政契約法制化以來的難題。本文以全民健康保險契約之司法實務進行探究，並認為司法院釋字第753號解釋有為健保契約之履約管理行為定性帶來新的思考可能，法國法行政契約之法理，也有值得我國行政契約履約行為定性參考之處。 During the performance of the administrative contract, when one of the parties is a citizen who failure to comply with legal obligations confirmed by contract, it has been a difficult problem since the legalization of administrative contract to know if the administrative authority shall preferential treat based on administrative contract rather than taking administrative disposition. This article explores the Judgments of Contract under the National Health Insurance Act of Administrative Courts. The author believes the interpretation No. 753 made by our Constitutional Court may bring new thinking to this difficult problem. The jurisprudence of the French administrative contract law also has some reference points for our country.
