    Abstract: 除了防止市場競爭受限制外，最近立法的趨勢是同時強調競爭的公平性，而特別從消費者的角度來評價個別競爭行為的正與不正使自由競爭、公平競爭、保護消費者這幾懂觀念得到某種程序的矛盾統一。因此「限制競爭」似乎更高次位的概念如平公貿易公平交易或市場法也漸次出現。然而在我國用「公平交易法」來涵蓋基本上屬於企業間平行「競爭」關係的規範，從統一法律用語的角度看似有商榷餘地；過去立法上所稱「交易」主要指企業或個人間垂直的「交換」關係，是所謂互通有無（交易），而不是共逐一鹿（競爭）的經濟行為。
