Abstract:	直到今日,在法律和政治哲學的概念裡,沒有任何一個概念組合像「公/私」領域(die öffentliche und private Sphäre)這樣複雜、富有挑戰性。在我們反省法律制度的深層結構和規範意識形態時,這一組概念左右了一般人的思考邏輯和範疇,影響及於對制度存廢和興革的觀點不僅南轅北轍,甚至彼此對立的論點無法相互溝通和理解。文化、國家、市場、族群、家庭,乃至媒體、學校、其他公共空間和個人的私密空間,都是我們常用的概念,然而在學術或非學術的討論中,充滿了對上述概念不一的見解,許多意義和理解上的分歧源於觀點的不同,源於價值偏見。最近台北高等行政法院關於大學退學規定違法的判決,引起爭議,是一個典型的例子刑法;律例;刑法典;大清新刑律;岡田朝太郎
