Title:	街頭藝人審查許可制與法律保留原則--司法院釋字第806號解釋評析

Abstract:	人民利用道路等公共空間從事藝文活動，以維生計，向來在行政法學上定位為公物之特別使用，須經主管機關之許可；未予許可，非對申請人構成基本權之侵害。然司法院釋字第 806 號解釋從人權保障角度出發，認街頭藝人於公共空間展演，亦受職業自由及藝術自由之保障。審查許可制係限制其基本權，應有法律保留原則之適用。本文從公共空間具基本權及公益實現多元功能之當代意義角度出發，原則上支持大法官之憲法視野，以基本權評價特別使用許可法制，賦予傳統公物法新意。然臺北市街頭藝人許可制度是否有違法律保留原則，本文認為在公物特別使用範疇內，恐有商榷餘地。
