This article argues that the Constitution should guarantee certain aliens’ “citizenship” or rights of “political participation.” Those rights at least include the right of political expression, the right to assembly, the right of association, the right to be a public official that is non-political in nature, the right to vote in local elections, the right of access to the ballot in local elections, and other political rights not directly involving national sovereignty. The theoretical grounds for the constitutional “right” of “aliens’ citizenship” include the following: (a) the text of the Constitution does not exclude aliens’ political rights; (b) certain “aliens” (e.g., marriage female immigrants) in reality have a very close relationship and mutual reliance with Taiwan so as to make them part of “We the People of Taiwan”; (c) the people governed by the state, as well as taxpayers, must be entitled to enjoy certain rights of political participation without regard to their nationality; (d) aliens are largely the systematically disadvantaged groups; (e) to confer a limited right of political participation to aliens is not necessarily repugnant to national sovereignty.
