Title:	研擬學產基金管理委員會組織條例與學產基金管理條例

Abstract:	「學產基金」係清朝時代地方熱心教育人士獻田捐地興學，其管理方式過去迄今均不明確，僅隨當時最適當之法令管理。精省後原屬台灣省教育廳所掌管之學產基金移轉給行政院教育部。學產基金所管理之土地，雖由原先登記為「省有」而「國有」，惟該土地學產地與一般省有或規有之「非公用財產」在性質上迥然有別。尤其民國八十六年修憲將憲法一百六十四條教育文化經費之比例與專款之保障予以刪除，教育經費失去了憲法最低下限之屏障，教育主管機關自主開發必須另闢教育經費財源，如能善用學產基金有效經營學產土地，建立「教育銀行」之理念，可使教育事業能有充分財源供應與分享，作為改革後盾。在組織法方面，將探討公法財團法人或私法財團法人之模式或其他公法人之型態，期能在組織內部人員任用、聘任、待遇、專長上具有較大彈性空間，強化企業管理經營之功能。在作用法部分，則待研擬「學產基金管理條例」，除了就學產基金管理之一般例行性業務運作方式為規範之外，主要目的在排除國有財產法上若干規定之拘束期能有效率地對學產基金作妥適運作管理。另一方面，經營學產基金（包括使用、收益、處分）之營收盈餘，也應排除國有財產法上「需繳交國庫」相關規定之適用。
