    Abstract: 政府近年極力推動金融市場自由化國際化，金融產品多元化已是必然趨勢。信託以其擴張權利、限縮責任之本質以及隱匿性、多樣性等彈性空間，極具成為下一波新型金融產品主力之潛力。惟法制完備為實務順利運作之前提，本書乃自比較法學角度探討信託法之理論與實務───就實務面而言，本書逐一檢視國內外信託產品之異同，特別是信託設計如何彌補我國固有財產移轉及管理模式缺憾，並評估信託業務之未來取向。就理論面而言，除以實務印證理論，探討其中盲點外，如何藉由法制設計，控制平衡信託本身所隱含之價值矛盾與衝突？而源於英美法系之信託，又如何與襲自大陸法系之基礎法制整合？是為本書兩大重點。
