    Title: 續論刑事程序之程序從新原則－評刑事訴訟法施行法第七條之三之實務見解

    Abstract: 最高法院 92 年台上字第 5168 號判決認為，依刑事訴訟法施行法第七條之上規定，告訴人在警詢時之陳述，經第二審怯院於審判期日依刑事訴訟法第一六五條規定調查，依舊法，既為合法證據，則第二審法院以該證據作為認定被告犯罪證據之一，即無違法之處。亦即第二審法院依舊法所為之合法調查程序，不會因新法施行而變成違法，因而被告以第二審判決違法（違背新法）作為上訴第三審理由，顯非合法。最高法院如此見解，偵得贊同。刑事訴訟法施行法第七條之三但書「 … 修正刑事訴訟法施行前已依法定程序進行之訴訟程序，其效力不受影響」規定，只是程序從新原則之一般說明，並非該原則之例外。至於法院於新法施行後必須踐行之訴訟程序（包括證據調查，證據能力之認定及審判程序）皆應依新法（刑事訴訟法施行法第七條之三本文規定）。第二審實務見解所示，一方面依新法進行審判，一方面又依舊法承認證據之證據能力，容有不當之處。
