Abstract:	陳水扁案從法院打到司法院，把幾個司法行政和刑事訴訟法的爭議，拉高到憲法的層次，其中又以法官分案和重罪羈押兩項最受矚目，在大法官之間也出現最大分歧，深入解讀第六六五號解釋會發現，分歧的主要原因還是在於審查的方法，多數大法官審查法院分案要點時，回到訴訟權給付公平審判的意旨，從有無恣意性的實質觀點切入，而未拘泥於憲法文本所無的法定法官原則，其方法較有利於解釋的可預見性。惟到了審查重罪羈押規定時，未揭露可能真正影響其心證的實務考察，反而對一個已經作了合憲調整的法條再做合憲性解釋，前後難以自圓其說，則為敗筆。
