    Abstract: 在手持式行動裝置、擴增實境、社群媒體以及雲端運算概念的推波助 瀾下, 全球各大博物館目前均開始朝著科技化服務創新的方向前進。然 而,其背後所牽涉的議題甚廣,包括智慧財產權議題、契約模式之變更以 及商業授權模式、甚至伴隨而生的隱私權、資料保護等問題目前均尚未有 完整的配套措施,且相關服務與授權條款也屬過去所無,這都容易造成館 方、使用者甚至是合作第三方的疑慮而延誤科技化服務創新的進程。 本子計畫將針對我國故宮博物院在此國際趨勢下將來可能面臨的法律 與智財問題加以分析並嘗試提出因應對策,並將以博物館的推廣與應用服 務市場為主,分別就博物館行動應用服務、擴增實境、社群媒體以及雲端 運算的現況進行介紹與調查,並提出可能的問題與建議方案,同時並將參 酌國外法院的實務見解以及博物館經營模式,以協助故宮於建立整合式的 科技化服務創新平台時,亦能妥善兼顧教育與文化推廣目的,將來更能將 故宮豐富的典藏瑰寶推向國際。
    Due to the recent rapid development of wireless technology, portable device, augmented reality, social media and cloud computing concepts, museums worldwide have taken steps toward initiating their own IT-enabled services. Nonetheless, while these services may have become more accessible and popular, a wider range of issues also arise while museums seek to exploit these services to communicate and promote their collections. These issues include, but not limited to, intellectual property, contract and business licensing mode evolution, not to mention the privacy, security and data protection issues, all of which will (if not directly) make the museums, users (and even the third party) hesitate to embrace such IT-enabled services. This sub-project is intended to analyze the problems which the National Palace Museum will be facing in such a trend. By focusing on the museum service oriented IT-enabled services market, we will make in-depth investigation into its latest development and propose our recommendations. We will also analyze foreign courts’ decisions and prevailing museum practices to assist the National Palace Museum to further build a comprehensive IT-enabled service platform. In the long run, we hope such a result will help the National Palace Museum to promote the national treasure to the international stage and show the world our commitment to art.
