Title:	臺灣保險法關於人身保險利益諸問題之再思考

Abstract:	關於人身保險之保險利益，現行臺灣保險法第十六條及十七條規定，仍未釐清人身保險利益重要問題。舉凡：人身保險保險利益需否存在、人身保險利益之構成要件、人身保險利益歸屬主體為何及人身保險利益應存在之時際等問題，於解釋適用上，均長期有爭議。本文首揭露現行法關於人身保險利益待釐清問題並分析理論與實務爭議所在，次比較美國法關於人身保險利益中相同問題之處理方法，再本比較法分析結果，輔以保險法基礎理論，就保險法關於人身保險利益之疑難覓得解決之道並重構臺灣保險法之人身保險利益制度。
