Abstract:	我國法未將土地及房屋所有權合一，如何因應有時出現土地所有權人訴請拆屋還地的問題，早已成為各界高度關注的問題。一九九九年民法債編修訂時，雖已參酌實務見解而增訂相關條文，但限於特定要件，始得適用。至就土地及其上房屋並非於特定時點同屬一人所有的情形，如何解決上述衝突，乃繼續成為深具爭議的問題。最高法院雖曾作成相關決議，但在實務運用上仍具有高度不確定性，有待進一步思考妥適解決之道。
