Title:	專利法之基本用語與法律體系概述

Abstract:	智慧財產雖非固有之物權，乃為隨著工業發展與創新而日益受到重視之財產權，其無體性，亦有別於傳統物權的特性，但仍有與傳統物權相對應的財產權體系。若能掌握此智慧財產權之體系，相信有助於瞭解智慧財產於各國法制之比較發展，亦利於閱讀解析以英文為原文之智慧財產相關判決、商務契約（特別是授權契約）學術論文與國際公約，增進智慧財產相關法學英文的能力。然而在此特別強調者，關於智慧財產的英文用語，雖有國際公約作出統整與示範，仍未有一致性。其主要理由，反映在國際智慧財產權法對於各國法制採取的是「和諧化」（harmonization）的方式消除岐見，而非採取「統一化」（unification）。亦即，在不違反國際公約規範內容的前提下，尊重各國無論由立法或判例法，將前述規範內容落實內國法制的方法。因此，國際智慧財產權法是允可各國就相關智慧財產要件與重要議題，依各國的法制自行發展。由各國隸屬不同法系之傳統，加之，相關文化社會發展未必相通，遂對智慧財產的概念，存在不同的理解與操作方法。此現象即直接投射於智慧財產之法學用語方面。是故，在研究智慧財產法學英文的同時，似應區辨英文用語於美國法系與歐洲法系的差異，更要瞭解其差異的理由，切勿將相關與語等同視之，以免造成對於各法系就相關議題之規範與操作，產生不必要之誤解。
