    Abstract: 交易基礎障礙理論(Die Lehre von der Störung der Geschäftsgrundlage),在台灣通常又叫做「情事變更原則」是一個在1920年代,由德國民法學者提出,並被當時帝國法院與其後的聯邦最高法院所接受,成為德國民法上的習慣法,且也為台灣學說實務所接受的一個重要的民事法理論。在2000年台灣民法債編修正後,我們更將之成文化,也就是現行民法第227條之2第1項的規定:「契約成立後,情事變更,非當時所得預料,而依其原有效果顯失公平者,當事人得聲請法院增、減其給付」。
