    Abstract: 交易基礎障礙理論（Die Lehre von der Störung der Geschäftsgrundlage），在台灣通常又叫做「情事變更原則」是一個在1920年代，由德國民法學者提出，並被當時帝國法院與其後的聯邦最高法院所接受，成為德國民法上的習慣法，且也為台灣學說實務所接受的一個重要的民事法理論。在2000年台灣民法債編修正後，我們更將之成文化，也就是現行民法第227條之2第1項的規定：「契約成立後，情事變更，非當時所得預料，而依其原有效果顯失公平者，當事人得聲請法院增、減其給付」。
