Title:	論對行政不作為之權利保護

Abstract:	在行政法之領域裡，因行政不作為即行政主體怠於行使公權力致人民之生命、身體、健康、財產受損害者，被害人民得否在法律上請求行政主體負賠償責任，馴至於在損害發生前請求行政主體發動公權力以防止損害之發生，在傳統之行政法與福利國家或給付行政之現代行政法，其根本之論點並不相同。前者持否定說，後者持肯定說，究竟其理論依據何在，其要件又如何，且現行行政救濟制度是否足以因應需要，如若不足，缺失何在，又如何補救與修正等問題，均是本論文所將探討之重點。
