Title:	保險業資金運用及失卻清償能力之研究

Abstract:	現代保險制度於清朝鴉片戰爭以後，隨海禁之開放，而傳入我國。惟其時，皆由外國保險公司於通商口岸設立分支機構，並由其把持。稍晚始有國人自營者。有關保險之立法雖曾數度制，然卻遲至民國五十二年始公佈現行保險法並施行之，保險業管理辦法之實施則為民國五十七年之事。現行法各項規定雖堪稱完備，然仍有未符理想者：有關業費資金運用及因運用不當失卻清償能力時之處置規定，即其中之大者。民國五十九年四月，國光人壽保險股份有限公司因資金運用不當，導致嚴重虧損，失卻清償能力，終為財政部命令停業，即此項立法未臻理想之明證，亦因此案件之發生，乃引發寫作本論文之動機，冀藉此探求保險業資金運用之原則，並研究業者失卻清償能力時，最佳之處置方式。
