Title:	間接正犯之研究

Abstract:	間接正犯，通常係指利用人之行為（如利用他人無故意行為或無責任能力人之行為以及無違法性之行為）而為自己的犯罪之情形而言。一般主張係為彌補共犯從屬性說在理論上之缺陷所產生之理論，而非在實定法上自然產生之概念。因其係假手於他人以實施自己之犯罪，與親自下手實施犯罪之單獨正犯有別，而就利用者與被利用者對於犯罪之協力關係的實質觀之，亦與本於共犯之意思，而促成他人犯罪之共犯迥異；故欲判別該背後之利用者，究為共犯？抑係正犯？其理論基礎何在？實非易舉。益因間接正犯概念係源於學說而逐漸展開學說所論又眾說分歧，不惟對其存在問題有肯定說與否定說之對立，即在承認間接正犯之概念下，對其範圍之認定，亦由於如何理解正犯概念，換言之，即由於採取共犯從屬性強弱之不同而有差異；故其概念自來即未明確劃一，不惟導致正犯與共犯概念之分際不明，抑且因正犯範圍之未臻確立，影響於人民權益之保障，至深且大，不容忽視概念雖未見於我國刑法典上唯實務上，不論大理院或最高法院之判例以及司法院之解釋，均予肯認。是以吾人對於間接犯之理論，自有加以研討之必要。惟有關間接正犯之問題甚多，本文僅就其概念、意義、成立要件及其正犯性之理論，以及錯誤與實行行為暨立法例等，試作初步之研討，以理論為主，佐以實例，期能闡明間接正犯之概念及其法的性格，疏漏之處，在所難免，容待將來再作進一步之探討也。
