    Abstract: 「促廉反貪」是各國公共行政最為關注的核心議題之一,因為貪污腐化不但危及政府的施政品質與民眾之權益,其更將降低國家整體的競爭能力。「行政監察」是達成「促廉反貪」的重要機制與手段。按一般學理見解,行政監察係對中央或地方行政權之運作加以監督、稽查的一種政治權力行為。我國雖然早有歷史悠久的監察體制與監察院的設置,但是隨著時代與憲政環境之變遷與更迭,其在反貪促廉上的功用似乎並不如預期。因此本文之主要研究目的是以反貪促廉的角度來探索分析我國的行政監察體系,特別是監察院與政風機關的行政監察功能;本文將從法制面來檢討我國目前行政監察與肅貪機制的組織、功能與成效,以釐清當前制度層面的限制與缺失,並為未來之制度革新奠立規劃的願景與基礎。
    “Promoting integrity and anticorruption” are among the critical issues that attract a serious attention of public administration around the world. It is widely acknowledged that corruption may not only undermine the quality of a government’s administration but also diminish its competitiveness. Administrative ombudsman is an important measure to combating corruption and promoting integrity. Given the current knowledge in this regard, it is submitted that administrative ombudsman is one kind of political intervention that aimed at investigating and remedying the executive power of central or local government. Although the power of ombudsman has long been institutionalized in this nation, its function has at best been mediocre and fails to meet the demand of current contingencies borne by constitutional changes. The purpose of this essay is to examine the institutions of administrative ombudsman in terms of its role in combating corruption, notably the roles play by Control Yuan and various offices of government ethics. This essay adopts a legal-institutional perspective to examine the current status of the institution of ombudsman, trying to sort out the associated limitations and caveats, and lay the ground works for future institutional reform and innovation.
