Title:	尋求總統和國會的平衡：雙首長制對台灣憲改的時代意義 Searching fo a Balance between the President and the Assembly

Abstract:	本文從歷史主義出發，認為憲政改革的本質，必須同時慮及制度規範和制度誘因，才能兼顧理想與現實。而有鑒於我國國會相對於行政部門的長期脆弱，本文認為一旦採行總統制，使強勢民選總統主導行政權，並剝奪國會對行政院的質詢監督權力，恐將造成總統獨裁的危險。但有鑒於國民黨立委的地方派系色彩濃厚和改革能力低落，以及民進黨長期受制於派系林立和整合能力薄弱，一旦改為內閣制，恐將導致治改革和政治整合能量的同時削弱。因此，本文基於民主發展的考慮，主張類似法國的雙首長制，認為雙首長制具有五項優點：維持府會權力平衡、維持全國領導中心、促進國會和政黨的全國發展、促進國民黨黨國體制的正常化、促進朝野協商和府會溝通。
