    Title: 一個中國內外有別對台灣之適用性的探討

    Abstract: 中共副總理錢其琛於二○○○年八月針對「一個中國」意涵,提出所謂的「新三段論」-世界上只有一個中國,大陸與台灣都是中國的一部分,中國的領土主權不容分割。此種提法雖然較突出兩岸平等的地位,不過,兩岸的問題不僅限於兩岸之間,尚涉及國際層面的問題,即是否有「內外有別」的問題。所謂「一個中國內外有別」,即中共在對外方面(國際上)不僅以「世界上只有一個中國」來凸顯一個中國原則,並且用「中華人民共和國政府代表全中國唯一的合法政府」,來確立此一中國即為中華人民共和國,否認中華民國的主權國家地位;在對內方面(兩岸之間)雖然同樣以「世界上只有一個中國」來凸顯一個中國原則,但用「大陸與台灣同屬於一個中國,中國的領土主權不容分割」之論述,避開一個中國是誰的問題。內外論述最大的差異在於一個中國究竟有否明指是誰的問題。本文將從國家的要件、實際管轄領土的變更及外交承認等各個方面,探討錢其琛的「新三段」的論述能否適用於在台灣的中華民國。
    In August 2000, Chinese Vice Premier Qian Qichen pronounced a new interpretation of Beijing`s ”One China principle,” stating that ”Taiwan and the Mainland are both part of China, and China`s territory and sovereignty cannot be separated.” Although this new position implies that Beijing is somewhat willing to treat Taiwan equally, Qian fails to clarify whether the new position can be applied to the international realm. In the international arena, Beijing has maintained that ”there is but only one China, Taiwan is part of China, and the PRC is the sole legal government of China.” Accordingly, the core issue remains that which side represents China in international community. This paper examines Qian`s new statement from the perspectives of the condition of state existence, change in territory, foreign recognition, with a focus on their implications for Taiwan.
