    Title: 第九屆立法委員提案策略分析-以2016年 罷免門檻修正為中心

    Abstract: 罷免門檻自1994年因立法院通核四預算,引發反核團體發動罷免活動而修法大幅提高後多年未變動,直至2014年太陽花學運浪潮興起開啟了一波罷免浪潮,後續2016年民主進步黨執政後,修法大幅調降。另法案提出為立法委員行使職權的必然職責,然基於罷免制度的變革與立法委員權益切身相關,罷免門檻修法調降後,是否對第九屆立法委員的提案內容帶來相關效應?成為本研究欲進一步探究的現象。
    本研究係以立法院第九屆2016年12月14修正通過之公職人員選舉罷免法罷免門檻為中心,並以修法前的第1及第2會期(2016年2月19日至2016年12月31日)及修法通過後的第3及第4會期(2017年2月17日至2017年12月19日),同時擇定區域立法委員進行比較分析,研究比較區域立法委員提案的數量與其多樣性。
    最後研究發現,罷免門檻修法後立法委員提出的法案在總提案量、跟著行政院提案量以及自主提案量均下降,至比例仍以自主提案較高。再來,就提案內容的多樣性而言,修法後立法委員在提案多樣性涉及的子議題並非如原先假設是增加,而是較修法前少。因此可以推論,修法後立委提案微趨保守。另外自主提案對於區域立法委員相對是比較重視的方式,透過多元的方式累積自身能量,獲得選民支持與認同,強化連任基礎。至於議提的多樣性顯見無論立法委員面對的情況如何,大多僅能關注少數議題。另外,立委的資深度與罷免門檻的修法有正相關,專業度則無關,本研究可再藉由擴大比較樣本以及質化分析再加以輔助檢視。
    The threshold for recall has remained unchanged for many years since it was significantly raised in response to the anti-nuclear groups` recall campaign triggered by the approval of four budgets by the Legislative Yuan in 1994. It wasn`t until the Sunflower Movement in 2014 that a wave of recalls began, and subsequently, after the Democratic Progressive Party came into power in 2016, there were significant amendments to lower the threshold. As recalling legislators is an essential responsibility related to their exercise of powers, and considering its impact on legislators` rights, this study aims to further explore whether the lowering of recall thresholds has had any relevant effects on the content of proposals made by members of the 9th Legislative Yuan.
    This study focuses on the threshold for recall of public officials, which was amended and passed by the 9th Legislative Yuan on December 14, 2016. It examines the first and second sessions (February 19, 2016 to December 31, 2016) before the amendment, as well as the third and fourth sessions (February 17, 2017 to December 19, 2017) after its passage. Additionally, it compares and analyzes the quantity and diversity of proposals put forward by regional legislators.
    After the revision of the recall threshold, it was found that both the number of bills proposed by legislators and the number of bills following the Executive Yuan and self-initiated proposals have decreased. However, The proportion is still higher for proposing legislation on their own. Furthermore, in terms of proposal diversity, it was discovered that legislators` proposals became less diverse after the amendment rather than increasing as originally assumed. Therefore, it can be inferred that legislators have become slightly more conservative in their proposals after the amendment. Additionally, regional legislators tend to place more emphasis on self-initiated proposals as a way to accumulate personal influence and gain support and recognition from voters, thereby strengthening their chances of re-election. As for issue diversity in proposing legislation, it is evident that most legislators can only focus on a few key issues regardless of their circumstances. Moreover, there is a positive correlation between legislator seniority and amendments to recall thresholds but no correlation with expertise level. This study could further examine these findings through expanding comparative samples and qualitative analysis for additional insights.
