    Abstract: 本研究擬參德國及歐盟關於職業安全健康保護法，釐清近代關於危險預防轉為危害風險評估及管理之理論，再檢視動部協助雇主進行風險危害辨識、評估與管理所發布之各項指引等相關規範之定位、內容，以及社會心理危害性事項，有否制定申訴與救濟專法之必要；並對職安法課雇主之義務，如何轉換民事上雇用人對其受僱人具防止其生命健康遭受侵害之保護義務；以及在風險評估與自主管理下，民法第483-1條如何對應職安法第6條、指引等規範，請求雇主採取必要措施與損害賠償，規範體系應如何定位與建構，較符合我國產業結構，提出立法部門修法展望，對於學術研究、國家發展及提供職安署、勞動檢查等各部門，建置與執行與社會心理因子危害有關之指引。
