    Abstract: 著作權法發展早期，以「保護類型」之認定為保護要件。當時僅有「天才」的創作，方能被稱為「原創」。時代變遷，各種新類型著作出現。希冀透過立法增加著作保護類型擴大著作權的保護，已顯不足，而「原創性」在此背景下形成。英國著作權之法理，影響美國著作權法早期發展。美國在大量訴訟案例的累積下，發展出自成體系之「來源追溯」及「創意衡量」之原創性意涵。我國判決採納美國法見解而形成「原始性」及「創作性」概念，亦使用歐陸「人類精神上創作」、「個性」或「獨特性」等用語。受各國見解影響下，致使原創性之意義混淆不清。本文以比較法觀點出發，研究我國判決及學術見解之歧異，祈供我國司法實務及學術研究之參考。
