    Abstract: 　　台灣地區雖已譽為世界大經濟貿易國之一，但是，對女性創造經濟奇蹟所須負擔的社會成本一兩性工作不平等與勞工權益保障不足等，卻未作出應有的回應性措施，亦未積極針對女性勞動者的需求創造一個支持性的工作環境；即便是勞動法令中與女性勞工關係最為密切、民國七十三年制定通過的勞動基準法，其保障女性就業權益的相關規定中，當初立法者的態度、以及在此些條文背後所隱晦的意識型態，是否果真以女性主體需求作為立法的考量？此為本篇論文的主要問題意識。
