Title:	我國勞動基準法退休金制度調整之研究

Abstract:	老年作為一種社會風險，在工業化社會逐漸為從屬身份的老年勞動者無力承擔。於是，先進工業國家遂發展出由政府建構社會保險老年年金制度，提供老年國民第一層的經濟保障，使其基本生活無庸匱乏，然後，再兼顧個人公平性，由政府立法鼓勵企業以福利方式辦理退休金制度，提供老年經濟安全第二層保障，俾退休勞工得享有適當之生活水准。實則我國早於民國三十九年即開辦有勞工保險老年給付。然而，以行政命令規範之廠、礦工人退休規則並無法之拘束力，其後，遂有民國七十三年公布實施之勞動基準法，特列退休專章，以法律強制保障勞工之退休權益。
