    Abstract: 法社會學的研究在近年來日益受到重視,本文主張法社會學的研究必須面對台灣法律與社會之現實困境,深切反省「法條主義」法律觀的社會意涵,並以此為基礎發展研究的框架。本文提倡發展有助於台灣法律與社會結合的法社會學研究,因而具體指出三個主要議題,展演將法律與社會重新結合的觀察與研究取向。這三個議題分別為「法律的社會動員」、「法律的文化解釋」以及「法律與國家組織行為」。本文希望透過這些法社會性的觀察與分析,解碼台灣法律、社會與文化之間的糾結,而這些解碼的研究能夠幫助我們看見法律運作過程中「人」的處境,並進而有能力挑戰法律、創造法律。
    Abstract: The emergence of socio-legal studies in the domain of Taiwanese law has been regarded as a newly development to catch up with western legal academic achievements. Yet Taiwanese scholars have not developed a framework to provide theoretical and empirical perspectives for analyzing socio-legal phenomena. This paper proposes better models to explore the predicament of “the rule of law” in Taiwan. It therefore firstly reflects the underlying logic behind “legal centralism” which dominates Taiwanese socio-legal thinking. It then provides three different socio-legal research models each of which contains a particular perspective and methodology for dismantling the socio-legal continuity developed through history, power and culture. This paper intends to present the public situation before the law and encourage us to challenge and create the law.
